Welcome to WindLoadCalc, LLC ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, software calculators, and subscription services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Services Description

Wind Load Solutions provides professional engineering calculation tools for determining wind loads on buildings and structures according to ASCE 7 standards. Our Services include:

• Web-based wind load calculators
• Subscription-based access to specialized calculation tools
• Technical documentation and support resources
• Professional calculation reports and documentation

2. Account Registration and Subscriptions

2.1 Account Creation

To access certain Services, you must create an account. When you purchase a subscription, an account will be automatically created for you. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your contact information is accurate and current

2.2 Subscription Plans

We offer various subscription plans with different features and pricing:

• Monthly Subscriptions: Billed monthly, cancel anytime
• Annual Subscriptions: Billed annually at a discounted rate, cancel anytime

2.3 Billing and Payments

• All payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for recurring subscription fees
• Prices are subject to change with 30 days' notice to active subscribers
• All fees are in U.S. Dollars (USD) and are non-refundable except as required by law

2.4 Free Trials and Promotions

We may offer free trials or promotional pricing. These offers are subject to additional terms provided at the time of the offer and are available only to new customers unless otherwise specified.

3. Cancellation and Refunds

3.1 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• You will retain access until the end of your current billing period
• No further charges will be made after the current period ends
• Your account and data will be retained for 90 days in case you wish to reactivate

3.2 Refund Policy

We offer refunds under the following circumstances:

• 7-Day Money-Back Guarantee: Full refund if requested within 7 days of initial purchase
• Service Issues: Pro-rated refund if our Services experience extended downtime (>24 hours)
• Billing Errors: Full refund for any duplicate or erroneous charges

4. Acceptable Use

• Reverse engineer, decompile, or attempt to extract source code from our software
• Use automated tools (bots, scrapers) to access our Services
• Resell, redistribute, or sublicense access to our Services
• Attempt to circumvent security measures or rate limits
• Use the Services to violate any applicable laws or regulations
• Submit false or fraudulent information

4.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

5. Professional Use and Limitations

5.1 Engineering Responsibility

IMPORTANT: Our calculation tools are designed to assist licensed professional engineers. The user is solely responsible for:

• Verifying all inputs and assumptions
• Reviewing and validating all calculation results
• Ensuring compliance with applicable building codes
• Making final engineering judgments and decisions
• Stamping and signing engineering documents where required by law

5.2 Not a Substitute for Professional Judgment

Our Services are calculation tools, not engineering services. They do not replace the need for professional engineering judgment, site-specific analysis, or compliance with local regulations.

5.3 Accuracy and Verification

While we strive for accuracy, users must independently verify all results. We recommend:

• Performing spot checks with hand calculations
• Comparing results with alternative methods
• Consulting relevant building codes and standards
• Using professional judgment in all engineering decisions

6. Intellectual Property Rights

6.1 Our Ownership

All content, software, designs, text, graphics, and other materials provided through our Services are owned by WindLoadCalc, LLC and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for the duration of your subscription, subject to these Terms.

6.3 Your Data and Calculations

You retain ownership of all input data and calculation results you generate. We do not claim ownership of your engineering work product.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of results
• Warranties that defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• NO LIABILITY FOR DAMAGES: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
• MAXIMUM LIABILITY: Our total liability for any claim arising from your use of our Services shall not exceed the amount you paid us in the 12 months prior to the claim
• ENGINEERING DECISIONS: We are not liable for any engineering decisions, designs, or construction based on calculations performed using our Services
• NO LIABILITY FOR DAMAGES RESULTING FROM: Errors in calculations, system downtime, data loss, security breaches, or unauthorized access

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless WindLoadCalc, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of another party
• Engineering decisions or designs based on calculations from our Services

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 Data Security

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

We retain your calculation history and account data for the duration of your subscription plus 90 days after cancellation, unless you request earlier deletion.

11. Modifications to Services and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance.

11.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending email notification to your registered email address

Your continued use of our Services after changes become effective constitutes acceptance of the updated Terms.

12. Termination

12.1 By You

You may terminate your subscription at any time as described in Section 3.

12.2 By Us

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended inactivity (6+ months)

12.3 Effects of Termination

Upon termination:

• Your right to access the Services immediately ceases
• You must cease all use of our software and materials
• Sections 5-10 of these Terms survive termination

13. Governing Law and Dispute Resolution

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
